1. General Information and Agreement Acceptance

1.1 Responsible Entity

This platform, accessible at https://dolphintech.io, is operated and managed by Dolphin Technologies, Inc., a corporation registered in the state of Florida, United States, with Employer Identification Number (EIN) 36-5141615 and registered address at 9000 Sheridan Street, Pembroke Pines, Florida, ZIP 33024. 1.2 Service Description

Dolphin Dashboard is the control panel and digital collaboration space of an operational unit of Dolphin Technologies, Inc., dedicated to software development, maintenance, and technological system consulting. Services offered include but are not limited to: custom software creation from scratch, continuation or restructuring of existing projects, technical and strategic consulting, technological infrastructure maintenance, and integration of traditional payment systems (banking) or decentralized (Web3). All services are governed by the Sundays methodology, based on assigning unique responsibilities to ensure speed, traceability, and total project control.

1.3 Scope of Application

Platform use is limited to persons over 18 years of age with legal capacity to contract. Services are available only in the following territories: the entire American continent, Europe, United States, Canada, United Arab Emirates, China, Singapore, Japan, and South Korea. Access from countries outside this list may be restricted or denied.

1.4 Agreement Acceptance

Registration on the platform implies express acceptance of these Terms and Conditions by the user. Such acceptance is formalized by marking a checkbox in the registration form, which constitutes informed, free, and voluntary consent. Continued use of the platform will also be considered as tacit acceptance of these terms.

2. User Registration, Onboarding and Information Veracity

2.1 Registration Process and Required Data

To use the platform https://dolphintech.io, the user must complete a registration process ('onboarding') in which essential personal and contact data is requested, including but not limited to: full name, email address, phone number, country of residence, billing data, and payment method (card or other supported method). The collection of this data is intended to ensure proper service provision and regulatory compliance.

2.2 Information Validation

Currently, formal identity verification is not required in all cases. However, Dolphin Technologies, Inc. reserves the right to request additional supporting documentation to validate identity, legitimacy or ownership, especially in large-scale projects or when necessary to create official accounts on behalf of the client. Refusal to provide such information may result in limitation or suspension of access to certain services.

2.3 Veracity and Fraud Consequences

The user agrees to provide truthful, updated and complete information. In case of detecting false, inconsistent or fraudulent data, Dolphin Technologies, Inc. reserves the right to: suspend or delete the user account, temporarily or permanently retain deposited funds if there are indications of fraud, and report the activity to local or international authorities competent in computer, financial or contractual crimes.

2.4 Individual Accounts and Team Access

Each account is designed to represent an organization, project or responsible person. From the main panel, the account holder can invite other team members with different roles (such as TAMs, engineers, HR managers, etc.) to participate in tracking active projects. Each member will access under their own profile, linked to the main account.

3. Services, Plans and Sundays Methodology

3.1 Services Description

Dolphin Technologies Consulting offers on-demand development, maintenance and technological integration services. These include: custom software development, continuation of existing projects, infrastructure maintenance, technical consulting on banking or Web3 payment systems, and design and coordination of technology projects. All services are provided under the Sundays Methodology, which assigns a Unique Responsible per project, in charge of ensuring traceability, speed, global vision and effective execution.

3.2 Types of Plans

Users can choose between the following plans at onboarding: FREE PLAN - $0 USD: Ideal to start, explore and evaluate our services. Includes direct contact with the team, generic domain in the test environment, and response times subject to availability. STARTUP PLAN - $200 USD (guarantee): Designed for startups seeking speed and personalization. Includes priority in project review, custom domain in Sundays Consulting, private dashboard, roadmap organization in first meeting, and full refund if initial meeting is not held within 7 days. ENTERPRISE PLAN - $1,000 USD (guarantee): Comprehensive solution with dedicated team and priority attention. Includes assigned team, fixed weekly meetings, specialized technical support, direct communication channel, included emailing service, and comprehensive case evaluation and execution.

3.3 Contracting, Meetings and Roadmap

Contracting begins from platform onboarding. Then, the client receives access to the dashboard and a meeting is coordinated to define the initial project roadmap. If this meeting is not held within 7 days, the system automatically cancels any collection attempt. Both parties may reject the continuity of the project after the initial meeting without economic penalty.

3.4 Project Access and Management

Each main account can invite multiple collaborators (such as technical managers, engineers, TAMS or HR personnel) with different access levels. Project progress, deliverables, meetings and documentation are managed completely from the user dashboard.

4. Payments, Billing, Processing and Refund Policies

4.1 Payment Processing

All payments made through the platform https://dolphintech.io are securely processed through Stripe, Inc., an international payment processing company certified compliant with PCI DSS (Payment Card Industry Data Security Standard). User card data is never stored on our servers and travels encrypted using bank-level SSL technology. The name that will appear on the user's account statement may correspond to Dolphin Technologies, Inc., holder of the payment infrastructure.

4.2 Card Registration as Guarantee

When selecting a paid plan (Startup or Enterprise), the system requests card data solely as a guarantee of contracting intention. No charge is made at the time of registration. The corresponding amount will only be debited if the following conditions are met simultaneously: the first meeting between the Dolphin Technologies team and the client takes place, and an initial work roadmap is agreed upon. If the meeting is not scheduled within 7 business days, the process is automatically canceled and no charge is made.

4.3 Refund and Cancellation Policy

The user may cancel the service at any time before the initial meeting directly from their control panel. Likewise, both the user and Dolphin Technologies may decide not to proceed with the project after the first meeting without any economic penalty. If the guarantee amount is charged and then the project is canceled for causes attributable to Dolphin Technologies, the refund will be automatic and complete within 5 business days. No refunds will be made once project development has formally begun, unless there is manifest breach of agreed deliverables by Dolphin Technologies, Inc.

4.4 Billing and Currency

All values are expressed in United States dollars (USD). Once the initial charge (guarantee or service) is made, the user will receive by email a digital invoice issued by Dolphin Technologies, Inc., with the corresponding tax information. If additional billing data is required (such as company name, EIN, CUIT or tax address), the user may upload them in their control panel or contact info@dolphintech.io.

4.5 Taxes and Fees

The user accepts that certain charges may include local, national or international tax rates, depending on the country or jurisdiction from which payment is made. Dolphin Technologies, Inc. assumes no responsibility for automatic perceptions applied by banking entities, cards or intermediate gateways.

5. Communications, Notifications and Contact Policy

5.1 Authorized Communication Channels

By registering on the platform, the user authorizes Dolphin Technologies, Inc. to communicate through the following channels: email (transactional, informational or follow-up emails), SMS text messages, internal notifications within the dashboard, and eventually, phone calls if the user has provided their number and authorizes it. The purpose of these communications is to inform about project progress, technical alerts, billing, meeting scheduling, post-sale follow-up and relevant service news.

5.2 Consent and Cancellation

The user may opt out of receiving non-essential promotional or informational communications at any time by accessing the notification settings in their profile or clicking the 'Unsubscribe' link at the bottom of emails. However, some communications are mandatory for technical or contractual reasons and cannot be disabled while the user maintains an active account. These include: meeting confirmations, changes to terms or policies, billing or payment information, and security alerts.

5.3 Data Protection

Dolphin Technologies, Inc. commits not to sell, rent or share user contact information with third parties for advertising purposes. All personal information will be treated in accordance with the current Privacy Policy, which is available on the platform and will be presented for acceptance along with these Terms and Conditions.

5.4 External Media Liability Limitation

The user understands that, while reliable delivery services (such as email and SMS platforms) are used, there may be failures beyond Dolphin Technologies' control that affect the receipt of notifications. It is the user's responsibility to keep their contact data updated and periodically review their dashboard panel.

6. Platform Use, Intellectual Property Rights and Licenses

6.1 Dolphin Dashboard Platform Use

Access to https://dolphintech.io and its functionalities is limited to registered users who have accepted these Terms and Conditions. Improper, automated, fraudulent use or use that alters platform operation is strictly prohibited and may result in immediate account suspension. The user commits not to: use reverse engineering on the platform, interfere with source code or authentication mechanisms, share their access with unauthorized third parties, or use the platform for illegal purposes or those not contemplated in the contracted services.

6.2 Platform Intellectual Property

All content, design, software, tools, texts, graphics and source code of the platform are exclusive property of Dolphin Technologies, Inc. or its licensors and are protected by intellectual property laws in force in the United States and international treaties. The user does not acquire any rights over the platform or its components, except those necessary for functional use during the validity of contracted services.

6.3 Client Code and Deliverables Property

All code, documentation, configurations, developments or integrations made specifically for the client as part of a contracted project belong fully to them, unless expressly agreed otherwise. Once the work is finished and delivered, the client acquires the rights of use, reproduction, modification and distribution without restrictions of the developed product. However, the Dolphin Dashboard platform and its internal tools are not part of those rights, and remain property of Dolphin Technologies, Inc.

6.4 Component Reuse

Dolphin Technologies, Inc. reserves the right to reuse for other projects generic, non-confidential components, modules or solutions developed during service execution, as long as they do not include sensitive information or client data. In case of confidential developments, these will be protected by non-disclosure agreements (NDA) when appropriate.

6.5 Licenses and Third Parties

The client is responsible for complying with the use licenses of any third-party technology integrated into the project (such as open source libraries, external APIs, databases or SDKs), as long as these are not directly provided by Dolphin Technologies.

7. Security, Confidentiality and Data Protection

7.1 Information Security

Dolphin Technologies implements reasonable technical, organizational and administrative measures to protect the confidentiality, integrity and availability of user information. These measures include: data encryption in transit (SSL/TLS) and, where applicable, at rest; external payment processing through Stripe, in accordance with PCI DSS standards; segmented access control within the technical team; activity logs for traceability and auditing; and periodic backups and measures against data loss. However, the user accepts that no system is infallible, and absolute security cannot be guaranteed against third-party attacks or other events beyond Dolphin Technologies, Inc.'s reasonable control.

7.2 Project Confidentiality

Every project initiated through Dolphin Technologies is considered strictly confidential, unless the client expressly requests to make it public or referenceable. Team members assigned to the project, as well as the systems used, operate under internal confidentiality agreements. Dolphin Technologies, Inc. commits to: not disclose sensitive client information, not share technical, strategic or personal details outside the project scope, and not reuse client data or results without explicit consent. The client, in turn, also commits not to disclose technical information about the internal operation of the Dolphin Technologies platform or the assigned team, except with prior authorization.

7.3 Personal Data Protection

The platform collects, processes and uses personal data in accordance with the principles of: lawfulness and transparency, specific purpose, data minimization, security and control, and limited retention. All data entered by the user in onboarding or during platform use will be treated in accordance with Dolphin Technologies, Inc.'s Privacy Policy, which is available and must be accepted along with these Terms and Conditions. In compliance with applicable laws (including the US CAN-SPAM Act and, where applicable, the European GDPR), users may at any time exercise their rights of access, rectification, cancellation and opposition by writing to info@dolphintech.io.

7.4 Incident Notification

In case of a relevant security breach that may compromise personal or confidential data, the affected user will be notified within the timeframes established by current legislation.

8. Final and Legal Provisions

8.1 Terms Modification

Dolphin Technologies, Inc. reserves the right to totally or partially modify these Terms and Conditions at any time. Any modification will be communicated to registered users via email and/or notification on the dashboard. Continued use of the platform after notification will imply acceptance of the new terms. If the user does not agree, they may request account closure without any penalty.

8.2 Duration and Termination

This agreement enters into force from the moment the user accepts the Terms and Conditions when registering on the platform, and will remain in effect while maintaining an active account or having contracted services. The user may request account closure at any time from their control panel or by writing to info@dolphintech.io. Dolphin Technologies, Inc. may also cancel the account in case of: serious breach of terms by the user, fraudulent conduct or security risks, or improper or illegal use.

8.3 Jurisdiction and Applicable Law

This agreement is governed by the laws of the State of Florida, United States of America, and any conflict will be resolved exclusively before state or federal courts with jurisdiction in Broward County, unless expressly agreed between the parties. The user accepts said jurisdiction as the only competent one to resolve any contractual, commercial or technical dispute arising from the use of the Dolphin Technologies platform.

8.4 Force Majeure

Neither party shall be liable for delays or breaches caused by causes beyond their reasonable control, including but not limited to: natural disasters, pandemics, massive infrastructure failures, wars, disturbances, power outages or widespread interruptions of digital services.

8.5 Divisibility

If any provision of these Terms and Conditions is deemed invalid, illegal or unenforceable by a competent court, such provision shall be interpreted in a manner consistent with current legislation, without affecting the validity of the rest of the agreement.
